FEES OF MEDIATION
1. Mediation fees include:
a) Administrative fees of VTIAC;
b) Mediation fee: Remuneration for Mediators conducting mediation;
c) Expenses arising from finding out the facts from a third person consulting experts, fees for assessment, valuation and consultation with experts.
d) Travel expenses, accommodation and other relevant expenses for the Mediator and session clerk.
dd) Expenses for renting meeting rooms and expenses related to the organization of mediation sessions at a location outside VTIAC's headquarters at the choice of the parties.
2. Unless otherwise agreed by the parties, each party shall bear 50% (fifty percent) of the fees covered by the Mediation fees mentioned in Clause 1 of this Article.
THE ADVANCE PAYMENT OF MEDIATION FEES
1. When submitting a Request for Mediation, the Party requesting mediation shall pay an advance of 50% (fifty percent) of the Administrative Fees and Mediation Fees mentioned in Point a) and Point b) Clause 1, Article 24 of the Rules. These fees are calculated according to the value of the dispute specified in VTIAC's Schedule of Mediation Fees in effect on the date of submitting of the Request for Mediation. In case the Request does not state the value, the specific fees shall be decided by VTIAC.
2. After obtaining a written response agreeing to mediation, the party receiving the Request for Mediation is also required to pay an advance of 50% (fifty percent) of the Administrative Fees and Mediation Fees mentioned at Point a) and Point b) Clause 1, Article 24 of the Rules.
3. Unless otherwise agreed by the parties, each party shall pay an advance of 50% (fifty percent) of the mediation expenses mentioned at Points c), d) and e) Clause 1, Article 24 of the Rules (if any). The parties must fully pay these cost advances within 10 (ten) days from the date of receipt of the VTIAC notice for the conditional Mediator to continue to conduct mediation.
4. Upon termination of the mediation process, in case the total amount advanced by the two parties is higher than the actual cost, VTIAC shall refund each party 50% (fifty percent) of the remaining amount of 11. In case the actual cost is higher than the total amount advanced by the two parties, each party must pay an additional 50% (fifty percent) of the missing amount to VTIAC.
