Fees of Arbitration


ARBITRATION FEES
The arbitration fee includes:
1. Remuneration for arbitrators settling disputes;
2. VTIAC's administrative fees related to dispute settlement;
3. Fees for expert consultations and other assistance at the request of the Arbitral Tribunal.
4. Travel, accommodation and other related expenses for arbitrators in the Arbitral Tribunal and session clerks.
5. The cost of renting a meeting room and expenses related to the organization of dispute resolution sessions at a location outside the headquarters of the VTIAC at the choice and request of the parties.


THE ADVANCE PAYMENT OF THE ARBITRATION FEE
1. Upon submission of the Request or the Supplement Request for Arbitration, the Claimant shall pay an advance of all arbitration fees referred to clauses 1 and 2 of Article 38 of this Rule. These fees are calculated according to the value of the dispute set forth in the VTIAC Schedule of Arbitration Fees and Administrative Fees schedule in effect on the date of submission of the Request. If the Value is not stated in the Request or Supplement Request, the specific fee shall be decided by VTIAC.
2. Upon submission of the Counterclaim, Supplement Counterclaim, the Respondent shall pay an advance of all arbitration fees referred to clauses 1 and 2 of Article 38 of the Rule to a Counterclaim or Supplement Counterclaim.
3. The prescribed fees in Clauses 3, 4 and 5 of Article 38 of this Rule (if any) shall be paid after the establishment of the Arbitral Tribunal. VTIAC shall consult with the Arbitral Tribunal to estimate the fees incurred during the settlement of the dispute and notify the parties. The Claimant shall pay all these fees within 15 days from the date of receipt of the notice from the VTIAC in order for the Arbitral Tribunal to conditionally continue to resolve the dispute. The Claimant may submit a request VTIAC for an extension of up to 15 days to pay these fees.
4. In the event that the dispute resolution meeting is adjourned and additional fees are incurred, after each postponement VTIAC shall make an estimate of additional costs and request the Plaintiff to submit an additional advance.
5. The settlement of actual fees shall be calculated by VTIAC to notify the parties and the Arbitral Tribunal before the Arbitral Tribunal issues an arbitral award. In case the advance amount is higher than the actual fees, VTIAC shall refund the party who paid the remaining amount. In case the actual cost is higher than the advance amount, the party who paid the advance must additionally pay to VTIAC the missing amount.
